NANP End User Licensing Agreement
In accessing the resources provided on this site from the National Animal Nutrition Program (NANP), you agree to the following terms, in this End User License Agreement (EULA).
1. Acceptance of Terms
By accessing and using the information including resources, assets, and data provided by the National Animal Nutrition Program (NANP) through its website animalnutrition.org or any other means, you (“you” or the "User") agree to be bound by the terms of this End User License Agreement ("EULA"). If you do not agree to the terms of this EULA, you must not use or access the NANP resources, assets, and data (the “Materials”).
2. Use of Resources
The NANP provides the Materials for informational purposes and to support the animal nutrition community. The Materials are intended to serve as a reference for animal feed, but not as a definitive source, for making business or operational decisions. The NANP reserves the right to make updates, modifications and changes or discontinue any aspect or feature of the Materials.
- Source Citation: The User agrees to cite the NANP as the source of the shared data in any publications, reports, or presentations that result from the use of this data, as follows: National Animal Nutrition Program. - Non-Commercial Use: The User agrees that the shared data will be used solely for non-commercial purposes. Any commercial use or potential profit derived from use of the data is prohibited without express written consent from the NANP.
- Commercial Use: If the User intends to use the shared data for commercial purposes, they agree to pay an annual licensing fee (to be negotiated directly with the NANP) for the right to use or distribute the shared data. In such an event, the User shall provide detailed records of commercial use to the NANP annually and cite the source (as mentioned above) when applicable.
- Non-Shareable: The User agrees not to share, distribute, or otherwise disseminate the shared data to any third parties without prior express written consent from the NANP.
- No Alterations: The User agrees not to modify or alter the shared data without prior express written consent from the NANP.
- Reporting Errors: If the User identifies any errors or discrepancies in the shared data, they agree to promptly report such findings to the NANP.
3. No Liability for Business Decisions
You, the User, acknowledge and agree that:
- The NANP is not responsible for the consequences of any business or operational decisions made based on the use of or inability to use the Materials.
- The information provided in the Materials is not intended to replace professional advice and should not be used as the sole basis for making business decisions.
- The User is solely responsible for any decisions made based on the use of the Materials.
4. No Warranty
Use of the Materials is at User’s sole risk. The NANP provides the Materials on an "as is" and "as available" basis, and without warranty of any kind, either express or implied, including without limitation, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Under no circumstances will the NANP be liable in any way for any content or materials of any third parties, including, but not limited to, for any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of the use of any such content.
5. Limitation of Liability
Under no circumstances shall the NANP, its affiliates, offices, directors, employees, or agents be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of or inability to use the Materials. If User is dissatisfied with the NANP Materials, User's sole and exclusive remedy is to discontinue use of the NANP Materials.
6. Modification of Terms
The NANP reserves the right to modify this EULA at any time. Your continued use of the Materials after any such modifications constitutes your acceptance of the new terms.
7. Termination
The NANP may terminate User's access to the Materials at any time and without cause.
8. Governing Law
This EULA and your use of the NANP resources shall be governed by the laws of the jurisdiction in which the NANP is based, without regard to its conflict of law provisions.
